These Terms of Service ("Terms") govern your engagement with the services (the "Service") offered by Yemflow ("we," "us," or "our"), a sole proprietorship registered in the Province of Alberta, Canada. By engaging our services, you agree to be bound by these Terms.
Yemflow provides professional website design and development services for service businesses in Calgary and across Canada, including a custom website build (one-time investment) and an optional monthly Care Plan covering hosting, SSL certificate management, domain renewal, and minor content updates.
To engage our services, you must provide accurate, complete, and current contact and business information. You must be at least 18 years old to use the Service.
Website Build: A one-time fee is charged for the custom website build. All prices are in Canadian Dollars (CAD). See our Pricing page for current fees. Payment is accepted via e-transfer to the details provided on your invoice.
Monthly Care Plan: If you opt into the optional Care Plan, you will be billed monthly via Stripe. The Care Plan can be cancelled at any time with no penalty - your website remains yours regardless.
Failed Payments: If a Care Plan payment is not received within 7 days of the due date, we may suspend hosting services until payment is received.
A one-time website build fee applies for new projects. Pricing details are available on our Pricing page. Promotional pricing offers are subject to availability and may be modified or discontinued at our discretion.
Care Plan Cancellation: Cancel the Care Plan anytime by contacting support@yemflow.com. Cancellation takes effect at the end of your current billing cycle. Your website remains yours after cancellation.
Website Build: Once work on a website build has begun, fees paid for completed work are non-refundable.
Data: Upon Care Plan cancellation, we will provide your website files for self-hosting. Billing data may be retained as required by law.
You agree not to use the Service to send unsolicited messages, harass or harm any person, violate any applicable laws, transmit malicious code, gain unauthorized access to systems, or resell the Service without written consent.
You retain ownership of all data and content you provide to us. You grant us a limited license to use it solely for providing the Service. You are responsible for ensuring your content complies with applicable laws.
Upon full payment for your website build, ownership of the completed website design and code is transferred to you. Yemflow retains ownership of its processes, tools, and general methodologies. You may not resell or sublicense our services without written consent.
The Service relies on third-party hosting and payment providers (including Stripe for Care Plan billing). We are not responsible for the availability or practices of any third-party services.
The Service is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the total amount you paid us in the three months preceding the claim.
You agree to indemnify and hold harmless Yemflow from any claims arising from your use of the Service or violation of these Terms.
We may suspend or terminate services at any time if we believe you have violated these Terms. The Care Plan may be cancelled by either party with reasonable notice.
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada. Disputes shall be resolved in the courts of Alberta.
